https://swimming-results.morsyssol.com/ (the "PWA"), you acknowledge
that you have read, understood, and unconditionally agree to be bound by these
Usage Notice, Copyright, Terms and Conditions (the "Terms").
Continued access to or use of the PWA constitutes your express and automatic
acceptance of these Terms and any updates posted by the Copyright Owner. If you
do not agree to these Terms, you must immediately stop accessing and using the
PWA and delete any copies of the Materials in your possession.
Usage Notice, Copyright, Terms and Conditions for SAQ-Swimming-Results PWA
1. Ownership and Copyright
1.1 Copyright Owner. The Progressive Web Application (PWA) hosted at
https://swimming-results.morsyssol.com/ (the "PWA") and all associated
content, source code, object code, assets, build scripts, configuration files,
compiled/minified outputs, documentation, and related materials (collectively,
the "Materials") are the exclusive copyrighted works of ixchua (the "Copyright Owner").
1.2 Copyright Protection. The Materials are protected by copyright law under the
Copyright Act (Cap. 63) of Singapore, by international copyright treaties and
conventions to which Singapore is a party (including the Berne Convention and the
WIPO Copyright Treaty), and by applicable laws in other jurisdictions. All rights
not expressly granted in this document are reserved.
2. Permitted Use
2.1 Viewing and Interaction. You are permitted to access, view, and interact
with the PWA in a web browser for personal, non-commercial use only.
2.2 Explicit License Requirement. Any use of the Materials beyond the limited
right to view and interact with the hosted PWA, including but not limited to copying,
reproducing, distributing, modifying, creating derivative works, publicly displaying,
embedding, sublicensing, or commercial exploitation, requires the Copyright Owner's
prior express written permission.
2.3 Repository License Precedence. If a separate license file or explicit
license statement is published in the PWA's source repository, that license governs
permitted uses to the extent it is explicit and unambiguous. Absent an explicit
permissive license, all rights are reserved.
3. Prohibited Conduct
The following actions are strictly prohibited unless you have obtained prior express
written permission from the Copyright Owner:
- Copying, mirroring, forking, republishing, redistributing the Materials in whole or in part.
- Reverse engineering, decompiling, disassembling, or attempting to derive source code from compiled, minified, or obfuscated artifacts.
- Circumventing or attempting to circumvent technical protections (including but not limited to build obfuscation, minification, access controls, or any other technical measures applied to the Materials).
- Removing, altering, or obscuring copyright notices, attribution, or license statements contained in the Materials.
- Using automated tools to extract, scrape, harvest, or copy non-public data or code from the PWA or associated hosting infrastructure beyond normal browsing behavior.
- Creating or distributing tools, scripts, or services designed to enable or facilitate any of the above prohibited acts.
4. Legal Basis and Applicable Laws
4.1 Singapore Law. Unauthorized access to, copying of, or interference with
computer programs, data, or systems may constitute an offence under the Computer
Misuse Act (Cap. 50A) of Singapore and may give rise to civil liability under Singapore law.
4.2 International Treaties and Foreign Law. The Materials are protected under
international treaties (including the Berne Convention and WIPO treaties) and under
the domestic laws of other jurisdictions. Unauthorized acts may also violate laws in
other countries, including but not limited to copyright statutes, anti-circumvention
provisions, and computer crime laws.
4.3 United States Law and DMCA. For users or service providers subject to
United States law, unauthorized copying, distribution, or circumvention of
technological protection measures may violate the Digital Millennium Copyright Act
(DMCA) and related statutes.
5. Enforcement and Remedies
5.1 Civil Remedies. The Copyright Owner reserves the right to seek all available
civil remedies for infringement, including injunctive relief, actual damages,
statutory damages where available, and recovery of attorneys' fees and costs.
5.2 Criminal Prosecution. The Copyright Owner may report unlawful conduct to
law enforcement authorities. Criminal prosecution may be pursued where applicable
under Singapore law or the laws of other jurisdictions.
5.3 Takedown and Notice Procedures. The Copyright Owner may pursue takedown,
blocking, or other remedial measures through hosting providers, platform operators,
or legal processes in relevant jurisdictions.
6. Indemnity
You agree to indemnify, defend, and hold harmless the Copyright Owner from and
against any and all claims, liabilities, losses, damages, costs, and expenses
(including reasonable attorneys' fees) arising out of or related to your breach of
these terms or your unauthorized use of the Materials.
7. No Warranty and Limitation of Liability
7.1 No Warranty. The PWA and the Materials are provided "AS IS" and
"AS AVAILABLE" without warranty of any kind, express or implied, including but not
limited to warranties of merchantability, fitness for a particular purpose,
non-infringement, or uninterrupted or error-free operation.
7.2 Limitation of Liability. To the fullest extent permitted by law, the Copyright
Owner shall not be liable for any indirect, incidental, special, consequential, or
punitive damages arising out of or relating to your access to or use of the PWA or
the Materials, even if advised of the possibility of such damages.
8. Governing Law and Jurisdiction
8.1 Governing Law. These terms are governed by and construed in accordance
with the laws of the Republic of Singapore.
8.2 Jurisdiction. Subject to any mandatory jurisdictional rules, the parties
submit to the exclusive jurisdiction of the courts of Singapore for any dispute
arising out of or relating to these terms.
9. Severability and Waiver
9.1 Severability. If any provision of these terms is held to be invalid,
illegal, or unenforceable, the remaining provisions will remain in full force and effect.
9.2 Waiver. Failure to enforce any right or provision under these terms does
not constitute a waiver of that right.
10. Updates and Modifications
The Copyright Owner reserves the right to modify, update, or replace these terms at
any time. Updated terms will be posted in the PWA or in the repository; continued
use of the PWA after posting constitutes acceptance of the updated terms.
11. Contact and Permission Requests
11.1 Permission Requests. To request permission to use, copy, modify, or
distribute the Materials, contact the Copyright Owner via GitHub at:
github.com/ixchua. Include a clear description of the requested use, the Materials
involved, the intended distribution, and contact information.
11.2 Notice of Infringement. To report suspected infringement or to provide
a takedown notice, provide a written notice that includes sufficient detail to
identify the allegedly infringing material and your contact information.
12. Miscellaneous
12.1 Entire Agreement. These terms constitute the entire agreement between
you and the Copyright Owner with respect to the subject matter herein and supersede
all prior or contemporaneous communications and proposals, whether electronic, oral,
or written.
12.2 Assignment. The Copyright Owner may assign or transfer its rights and
obligations under these terms without restriction.
